Asked about the Japanese Concession to which they are entitled under the Agreement with China of the 22nd December, 1905, Mr. Segawa said it had been his intention to create a Concession out of this land and the neighbouring property, including the land along the river front (mostly British). Where now the Japanese Concession, if any, is to be Mr. Segawa did not know.

Mukden, February 27, 1907. Sir,

I HAVE the honour to forward herewith translations of Japanese Regulations for Railway Settlements in Manchuria issued by the Governor-General of Kwantung, and Japanese Consular Regulations and Taxation Schedule for the Mukden Japanese Settlement Association, also a census of the Japanese population of the Southern Manchurian towns.

These papers are interesting as showing the system by which the Japanese can evade the necessity for an Agreement with the Chinese authorities as to the constitution of Japanese Settlements, as witnessed in the case of the land at Newchwang recently incorporated with the original railway land.

Large areas of land have been acquired at the various railway stations along the South Manchurian Railway by the railway authorities, notably at Mukden, Liao Yang, and Tiebling, and will no doubt be developed under the first-mentioned Regulations.

Regulations for Settlement Assemblies on Territory belonging to the South Manchurian

(Translation.)

Railway.

THE Regulations for Settlement Assemblies on territory belonging to the South Manchurian Railway have been determined as follows:--

1. The Chief of Police may establish Settlement Assemblies outside Kwantung Province at such places on territory belonging to the South Manchurian Railway as he deems necessary.

2. A Settlement Assembly shall consist of persons residing within determined limits on territory belonging to the South Manchurian Railway. Nevertheless, whenever the number of houses, the population, and distances between two or more Railway Settlements are such that it is deemed necessary, such Settlements may be combined under one Assembly.

3. The Settlement Assembly shall deliberate upon and administer sanitation, public works, education, and all other matters pertaining to the general interests of the Settlement.

4. The Settlement Assembly shall consist of one President, one Vice-President, and a number of Councillors. The number of Councillors shall be determined by the Chief of Police.

5. The President and Vice-President shall he appointed by the Chief of the Police with the consent of the Governor-General.

6. The Councillors shall for the present be nominated by the Chief of the Police and elected by the settlers. The Chief of Police shall, as soon as he has nominated the Councillors mentioned in the preceding paragraph, immediately report the same to the Governor-General.

7. The offices of President, Vice-President, and Councillor shall be honorary. The term of office shall be one year.

8. The Settlement Assembly may, with the consent of the Chief of Police, appoint a business manager and such other salaried officials as deemed necessary.

9. The President and Vice-President possess ipso facto the qualifications of Councillors The President shall preside at sessions of the Assembly, and as the representative of the Assembly shall enforce its Resolutions. The Vice-President shall take the place of the President whenever the latter is unable to discharge his duties. The Councillors shall represent the Assembly, and at its sessions shall have the right to propose Resolutions and shall participate in the enforcement of the provisions thereof.

10. The President, whenever matters for public discussion arise, shall convene the Assembly. The Assembly shall be convened whenever more than one-third of the Councillors demand it.

11. A majority of the Councillors shall be necessary to constitute a quorum to deliberate

upon matters before the Assembly, and a majority of votes shall be required to pass a Resolution. In the case of a tie, the President shall cast the determining vote.

12. The Settlement Assembly, in order to meet the expenses required in the application of Article 3, may draw up a schedule of the character and amount of taxes and may levy and collect the same from the settlers.

13. The Resolutions of the Settlement Assembly must receive the approval of the Chief of Police. The Chief of Police, whenever he shall have given the approval mentioned in the preceding paragraph, shall report the same to the Governor- General. Whenever the Governor-General shall consider the Resolutions approved by the Chief of Police as improper or illegal, the same shall be cancelled. He shall also have the right to issue orders to stop the execution of the same.

14. The Settlement Assembly, in order to furnish a clear statement of receipts and disbursements, the Budget, and the settlement of accounts, shall provide itself with the necessary books for that purpose, and at the end of each month shall submit a detailed report of the financial conditions to the Chief of Police.

15. The Settlement Assembly, in making disbursements of sums of more than 100 you, must receive the approval of the Chief of Police for the same.

16. Whenever the jurisdiction of the Settlement Assembly is contiguous with that of a Consular office, they shall deliberate together with the Executive Committee of the Consular Settlement Association in regard to matters affecting their common interests, and, as far as their obligations permit, shall co-operate with such Committee in the execution of Resolutions pertaining to the same.

17. The Governor-General, whenever he deems it necessary to the public peace, may dissolve the Settlement Assembly, and cancel the appointments of the President, Vice-President, and Councillors.

18. The Settlement Assembly shall draw up Rules in accordance with these Regulations for the performance of all matters of business thereby provided for, and shall secure the approval of the Chief of Police for the same, and shall then enforce them.

Supplementary Regulations.

19. When the South Manchurian Railway Joint Stock Company shall have commenced operations, these Regulations shall not be applicable to matters concerning whose administration Government orders shall be issued, and, if at present applicable, shall cease to be so upon the issue of such orders.

20. These Regulations shall not be applicable to Settlement Assemblies for whose organizations special provisions have been made.

21. These Regulations shall take effect from the 1st day of the 2nd month of the 40th year of Meiji (the 1st February, 1907).
